ORDER OF DISMISSAL

This action involved The Imaging Center's application for a letter of non-applicability determining that the Certificate of Need requirements of the State Certification of Need and Health Facility Licensure Act did not apply to a proposed project in Aiken, South Carolina. Prior to this tribunal's grant of leave for intervention, Respondent South Carolina Department of Health and Environmental Control (DHEC) and Petitioner entered into a Consent Order. By Notice of Withdrawal dated February 15, 2001, Alexander Twedt, attorney for Petitioner, notified this tribunal that it has submitted a Certificate of Need Application on January 30, 2001, for the establishment of a diagnostic imaging center to include a CT scanner and MRI unit pursuant to the Consent Order. Further, Petitioner wishes to withdraw its request for a contested case hearing challenging DHEC's November 20, 2000, decision revoking its April 8, 1999, letter of non-applicability and requiring Petitioner to discontinue its operations.

IT IS THEREFORE ORDERED that the above-captioned case is hereby dismissed with prejudice.
