ORDERS:

CONSENT ORDER OF DISMISSAL

WHEREAS, this proceeding before the Administrative Law Judge Division was initiated by the Petitioner Greenville Memorial Medical Center to seek review of the initial decisions dated August 21, 2000 by the South Carolina Department of Health and Environmental Control to (1) issue a Certificate of Need to Oncology and Hematology Associates of South Carolina, L.L.C., d/b/a The Carolina Clinical PET Institute for the purchase of a Positron Emission Tomography ("PET") Scanner, and (2) deny the issuance of a Certificate of Need to Petitioner for the lease of a mobile PET Scanner; and

WHEREAS, Petitioner hereby stipulates to the dismissal of this review proceeding; and

WHEREAS, each of the undersigned parties join in the foregoing stipulation and further stipulate their agreement to the dismissal of this action with prejudice, with each party to bear its own costs and attorneys' fees incurred in connection herewith;

IT IS HEREBY ORDERED, upon the stipulation and consent of the parties hereto, that the foregoing action be dismissed with prejudice, with each party to bear its own costs and expenses.

IT IS FURTHER AGREED AND ORDERED that a facsimile copy of this Order shall serve as and have the same force and effect as the original.

AND IT IS SO ORDERED.
