ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division ("Division") for a contested
case hearing upon the request of Lorraine Socci ("Petitioner"). By letter dated May 20. 1998,
counsel for Respondent, South Carolina Department of Health and Environmental Control
("DHEC"), notified this Division that Petitioner filed a letter, also dated May 20, 1998, withdrawing
the appeal. The letters are attached hereto and incorporated as Exhibit A. By withdrawing the
request for a contested case hearing, there appears to be no further controversy for consideration.
THEREFORE, IT IS ORDERED that the above-captioned case matter is hereby
DISMISSED.

Dear DHEC Officials:
Since my NOTICE OF INTENT TO APPEAL dated April 11, I had the opportunity to
discuss with George Madlinger the permit to construct a 4' by 200' walkway with handrails
leading to a 10' by 10' fixed pier head issued to Mr. & Mrs. Bennett.
Mr. Madlinger explained that there is an approximate 20' wide title creek that the proposed
dock will access, allowing fishing and crabbing. Mr. Madlinger commiserated with my
concern for setting a negative president for the proposed activity.
Mr. Malinger's knowledge of the area and willingness to discuss the project from both the
perspective of the property owner and DHEC, has provided me with a certain level of
comfort.
Based on the above, I withdraw my appeal.
