ORDERS:
ORDER GRANTING MOTIONS TO DISMISS
On September 3, 2003, Respondents South Carolina Department of Health and Environmental
Control (“DHEC”) and Open MRI and Imaging of Florence, LLC (“Open MRI”) filed separate
Motions to Dismiss in this matter, alleging that the Petitioner’s request for a contested case hearing
was not timely filed and, therefore, the Administrative Law Judge Division lacks subject matter
jurisdiction. On September 12, 2003, the Petitioner filed its response to the Motions to Dismiss,
stating that it does not oppose the Motions to Dismiss filed by the Respondents and that it consents
to an order dismissing this action.
THEREFORE, upon motion of the Respondents and with the consent of the Petitioner,
IT IS HEREBY ORDERED that this matter is dismissed with prejudice.
AND IT IS SO ORDERED.
