ORDERS:
CONSENT ORDER OF DISMISSAL
This contested case action was initiated by Petitioner Marlboro Park Hospital.
Petitioner contests a determination by Respondent South Carolina Department of Health
and Environmental Control that Certificate of Need requirements do not apply to
Respondent Scotland Memorial Hospital’s (Scotland) proposed project to provide MRI
services in Bennettsville, South Carolina. Scotland has now determined to withdraw its
project. As a result, the parties consent to a dismissal of this action.
WHEREFORE, it is hereby ordered that this action be dismissed without
prejudice.
AND IT IS SO ORDERED.
