ORDERS:
ORDER AND DECISION
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp.
1994) for a hearing pursuant to the application of Daniel S. McAteer, d/b/a 321 Quick Stop. The
applicant seeks an off-premises beer and wine permit (AI 104742) for a convenience store located
at 2261 Highway 321 South, outside the city of York, York County, South Carolina.
After timely notice to the parties and the protestants, a hearing was held at the
Administrative Law Judge Division on December 11, 1995 in Columbia, South Carolina. Wayne
and Nancy Sandifer, J.W. Barnette, Ruth D. Thomas, and Ann H. Nivens, the protestants of
record, failed to appear at the hearing or to make a Motion for a Continuance, thereby, waiving
their protests.
On November 22, 1995, Rev. Jack L. Fenner filed a Motion to Intervene in the above-captioned matter. By letter dated December 5, 1995, this tribunal notified all parties and Jack L.
Fenner, the potential intervenor, that this Motion would be considered at the hearing of this
matter on December 11, 1995. However, Jack L. Fenner failed to appear at the hearing, thereby,
waiving any right to intervene. For the foregoing reasons, there is no opposition of record to the
Petitioner's application.
IT IS THEREFORE ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to
process the application of Daniel S. McAteer, d/b/a 321 Quick Stop for an off-premises beer and
wine permit at 2261 Highway 321 South, York County, South Carolina.
AND IT IS SO ORDERED.
