ORDER OF DISMISSAL

The Petitioner, Harold E. Schronce, applied for an on-premise beer and wine permit for Slims Sports Bar in Seneca, South Carolina. After that application was protested the Department transmitted this case to the Administrative Law Judge Division. A hearing was scheduled pursuant to that transmittal for November 29, 1995, at the Administrative Law Judge Division in Columbia, South Carolina. A Notice of Hearing was mailed to all parties and Protestants of record. The US Postal Service Return Receipt reflects that the Petitioner received a copy of that Notice of Hearing on October 11, 1995. However, the Petitioner failed to make a Motion for Continuance or appear at the Hearing. Therefore, the Petitioner's application is deemed abandoned or withdrawn pursuant to ALJD Rule 23.

IT IS HEREBY ORDERED that the Petitioner's application for an on-premise beer and wine permit is denied and this matter is dismissed with prejudice.

AND IT IS SO ORDERED.
