ORDER OF DISMISSAL

In the above-captioned matter, the protestant, Chief Franklin McAllister of the Florence County Sheriff's Office has advised the Administrative Law Judge Division, by letter dated July 14, 1995, that the protestant withdraws its protest. The protestant initially opposed the issuance of an on-premises beer and wine permit (AI 103622) to Michael Sealy, d/b/a Jo-Jo's. Upon withdrawal of this protest, there is no opposition to the petitioner's application, therefore, a hearing is no longer necessary.

IT IS THEREFORE ORDERED that the hearing scheduled for Monday, August 21, 1995 is hereby cancelled.

IT IS FURTHER ORDERED that this matter is dismissed and that the Department of Revenue and Taxation continue to process the application of Michael Sealy for an on-premises beer and wine permit.

AND IT IS SO ORDERED.
