ORDER OF DISMISSAL

This matter is before the Court on the Petition of MUSC University Medical Associates concerning SC DHEC's decision that the Charleston Cornea and Refractive Surgery, PA did not need a Certificate of Need review because it did not meet the applicability requirements set forth in SC Code Ann. §44-7-110 et seq. and attendant regulations. After extensive discovery, motions and several continuances, the matter was set for trial on February 18, 2003. By Stipulation of Dismissal filed January 29, 2003, the Parties notified the court that they stipulated to the Dismissal of this action with prejudice and with each party bearing its own attorneys fees and costs.



AND IT IS SO ORDERED.
