ORDER OF DISMISSAL

This matter is pending before the Administrative Law Judge Division pursuant to a protest of John F. Tuite's renewal application for a beer and wine permit and a business sale and consumption license. Since receiving the South Carolina Department of Revenue and Taxation's ("Department") transmittal concerning Tuite's application, our office received a letter by the sole Protestant, Northgate Merchants Association, Inc., dropping the protest into this matter. Nicholas P. Sipe, attorney for the South Carolina Department of Revenue and Taxation, informed our office that the Department has no objection to the Petitioner's beer and wine permit and business sale and consumption license being renewed.

IT IS THEREFORE ORDERED that the above matter be dismissed.
