ORDERS:
ORDER AND DECISION
This matter comes before me pursuant to S.C. Code Ann. § 61-1-55 (Supp. 1994) and
S.C. Code Ann. § 1-23-310, et seq. (Supp. 1994) for a hearing pursuant to the application of
Charlotte Clements. The applicant seeks an on-premises beer and wine permit (AI 101389) and a
club sale and consumption license (101390) for a business located at 1877 Dorchester Road,
within the city of North Charleston, county of Charleston, South Carolina.
After timely notice to the parties and the protestants, a hearing was held at the
Administrative Law Judge Division in Columbia, South Carolina. By previous Order of this
Division, dated March 20, 1995, Carolyn Harrison was granted leave to intervene. A consent
Order dated April 28, 1995, was entered into the record to substitute David Bowers as the
Intervenor in lieu of Carolyn Harrison.
Petitioner, Charlotte Clements, was not present at the hearing. Ralph E. Hoisington,
attorney for the Petitioner, did not move for a continuance on behalf of his client as the Petitioner
"was not willing or able to provide" specifics about the nature of her family emergency.
E. Lindsay Blanks, attorney for the Intervenor, moved for Dismissal of the above-captioned matter, pursuant to Rule 23, Temporary Operating Procedures of the Administrative
Law Judge Division, without objection.
IT IS HEREBY ORDERED that this matter is dismissed pursuant to Rule 23,
Temporary Operating Procedures of the Administrative Law Judge Division.
AND IT IS SO ORDERED.
