ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division ("Division") pursuant to Petitioner's
application for a retail liquor license. The Department of Revenue filed an Agency Transmittal form
with the Division on February 1, 2001. The application was protested by Reverend David Swofford and
Ms. Eileen Mostiler. In a letter dated May 7, 2001, Reverend Swofford indicated he wished to
withdraw his protest of the application.
During a telephone conversation on May 7, 2001, Ms. Mostiler also indicated she wished to withdraw
her protest. The office of the undersigned asked her to send a letter memorializing her wishes. On May
15, 2001, the office of the undersigned mailed a letter to Ms. Mostiler requesting the letter withdrawing
her protest. The letter further provided, "If I do not receive your letter on or before May 20, 2001,
Judge Kittrell will issue an order dismissing this case." The office of the undersigned has not received a
letter or other communication from Ms. Mostiler.
In the Agency Transmittal form, the Department indicated it would have issued the license in this case
but for the protests of Reverend Swofford and Ms. Mostiler.
IT IS HEREBY ORDERED that the above-captioned matter is forwarded to the Department of
Revenue to continue to process the application of G and J Company, LLC, d/b/a Stop and Shop, 398
Gossett Road, Spartanburg, SC and to issue the requested license.
IT IS FURTHER ORDERED that this matter is dismissed.
AND IT IS SO ORDERED.
