ORDER OF DISMISSAL

This matter is before the Administrative Law Judge Division ("Division") pursuant to Petitioner's application for a retail liquor store license. The application was protested by Mr. W.D. Dill, Ms. Julane Dill, Mr. Jack Whittled, Ms. Polly Whittled, and Ms. Jackie Whittled. After notice to the parties, a hearing was scheduled for Monday, March 26, 2001. The Notice of Hearing was mailed to all Protestants on February 12, 2001. By letter dated March 23, 2001, Mr. Dill informed the undersigned that he and Ms. Dill would not be able to attend the hearing due to health reasons. The other Protestants also did not appear at the hearing. Absent testimony from any of the Protestants, the protest is deemed abandoned.

IT IS HEREBY ORDERED that the above-captioned matter is forwarded to the Department of Revenue to continue to process the application of Poinsett Beverage, Inc., 2700 A Poinsett Highway, Greenville, SC, and to issue the requested permit.

IT IS FURTHER ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
