ORDER OF DISMISSAL

On January 11, 2001, the Department filed a motion to dismiss this matter based on Protestants' withdrawal of their protest. The Department would have issued the on-premise beer and wine permit and minibottle license except for the filing of the public protest. On January 11, 2001, the Department received a letter signed by the Protestants indicating their desire to withdraw their protest. Attachment to Respondent's Motion to Dismiss. The Protestants have met with the Petitioners and have entered a cooperative arrangement to clean up the community, including assurances that Petitioners' business will operate as a "first class eating place."

Therefore, since it appears that the only justiciable issue has been resolved, IT IS HEREBY ORDERED that the hearing scheduled for February 15, 2001, is canceled.

IT IS FURTHER ORDERED that the Department shall issue the on-premise beer and wine permit and minibottle license to the Petitioners. The above-captioned case is hereby dismissed with prejudice.
