ORDER OF DISMISSAL

This matter is before me on the application of Phan Ngoc Le, d/b/a Gee Gee Food Store ("Petitioner"), for an off-premises beer and wine permit for Gee Gee Food Store, located at 1001 Saluda Street, Rock Hill, South Carolina. The application was protested by Alicia Sutton. Respondent S.C. Department of Revenue was excused from attending the hearing in this matter by my Order signed April 24, 2000, pursuant to Respondent's Motion to be Excused in which the Department stated it would have issued the permit but for Ms. Sutton's protest. After notice to the parties, a hearing was scheduled for July 11, 2000. Petitioner's attorney appeared at the hearing and stated that Petitioner wished to withdraw his application. Finding good cause,



IT IS HEREBY ORDERED that the above-captioned case be dismissed.



AND IT IS SO ORDERED.
