ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") for a contested case hearing upon the request of Luis Felipe Robledo, d/b/a Las Vegas Cantina, Inc. ("Petitioner"). Petitioner filed an application with the South Carolina Department of Revenue ("Respondent") for a sale and consumption (minibottle) license. The application was forwarded to the Division for a contested case hearing, citing a Protestant's challenge to the suitability of location. The merit hearing was scheduled for Monday, May 1, 2000, at 2:00 p.m. at the Division. In a letter dated April 28, 2000, Petitioner notified the Division of his desire to withdraw the application for the minibottle license. The letter is attached hereto and incorporated as Exhibit A. By virtue of Petitioner's request for withdrawal of said application, there appears to be no further controversy for consideration.

IT IS THEREFORE ORDERED that the above-captioned case is hereby DISMISSED.

AND IT IS SO ORDERED.
