ORDER OF DISMISSAL

This case is before me pursuant to the Petitioner's appeal of the Respondent's Notice of Disqualification dated August 29, 2002. Respondent filed an Agency Transmittal Form on September 19, 2002.

Pursuant to Proviso 55.3 of the 2002-2003 Appropriations Act, a filing fee is required to accompany each request for a contested case hearing, notice of appeal or request for injunctive relief. Because the fee was not received with the request, the Clerk's Office sent a Memorandum to Petitioner on September 19, 2002 giving notice that the case would not be assigned until the filing fee had been paid or a waiver requested. Petitioner failed to submit the filing fee or to request a waiver within the required time period and the case was returned unprocessed.

Petitioner subsequently filed a letter with the filing fee on October 17, 2002 requesting that the case be assigned. The case was assigned on October 22, 2002. Petitioner's check for the filing fee was subsequently returned for non-sufficient funds. The Business Manager of the Administrative Law Judge Division sent a letter to Petitioner on November 1, 2002, stating that the checks had been returned and that the fee must be paid. Since that time, Petitioner has not responded or communicated with this office. Therefore,

IT IS ORDERED that this case is hereby dismissed.

AND IT IS SO ORDERED.
