The Department of Corrections (Department) filed a Motion to Dismiss
with the Administrative Law Judge Division on September 13, 2001, setting
forth that the Appellant has been released from the custody of the Department
thereby rendering this appeal moot. SeeMathis
v. South Carolina State Highway Dep't, 260 S.C. 344, 195 S.E.2d
713 (1973) (An issue is moot when a judgment on the issue will have no
practical effect on an existing case or controversy.) Therefore, finding
good cause,
IT IS HEREBY ORDERED that this appeal be DISMISSED.
