This appeal is currently before the South Carolina Administrative Law Judge Division pursuant to the Appellant's Notice of Appeal filed on December 19, 2000. The Respondent filed a Motion to Dismiss on March 1, 2001.

The Appellant received the Final Agency Determination on May 19, 1999. He filed his Notice of Appeal on December 19, 2000. Appellant, therefore, did not file his appeal in a timely manner. ALJD Rule 62 requires that the Notice of Appeal be filed with the Division within thirty (30) days of receipt of the decision from which the appeal is taken. In this case, the Appellant failed to comply with ALJD Rule 62. Therefore, for good cause shown, it is hereby

ORDERED that this case is DISMISSED WITH PREJUDICE.

AND IT IS SO ORDERED.
