ORDER OF DISMISSAL

The Order Governing Procedure for the above referenced matter was issued by the undersigned Administrative Law Judge (ALJ) on September 8, 2000. It was ordered that Respondent file the Record on Appeal on or before October 13, 2000. It was also ordered that Appellant file Appellant's Brief on or before November 2, 2000. Respondent filed the Record on Appeal with the Administrative Law Judge Division (Division) on October 12, 2000. Appellant did not file the Brief by November 2, 2000 with the Division. The undersigned ALJ issued an Order on December 12, 2000 requiring Appellant to file the Brief. Said Order also informed Appellant that this matter may be dismissed upon the failure to file the Brief. As of the date of this Order, Appellant has not filed the Appellant's Brief.

Pursuant to ALJD Rule 38 an ALJ may dismiss an appeal for failure to comply with any of the rules of procedure for appeals.

IT IS THEREFORE ORDERED that the Appellant is in default and that the above-captioned case is hereby dismissed with prejudice against Appellant.

AND IT IS SO ORDERED.
