ORDER

This matter is before the Administrative Law Judge Division (Division) upon the request of the Petitioner, Thomas D. Crooks, Jr., for injunctive relief. Petitioner seeks an order from this Division compelling the Respondent, South Carolina Department of Corrections, to comply with an Order issued April 28, 2000, by Circuit Judge Henry McKellar in Civil Action No. 99-CP-32-1609. That Order remanded the Petitioner's post-conviction relief action to the Respondent, with instructions that the Respondent permit the Petitioner an immediate appeal to this Division pursuant to Al-Shabazz v. State, Op. No. 24995 (S.C. Sup. Ct. filed February 14, 2000) (Shearouse Adv. Sh. No. 6 at 21), 2000 WL 156547. Petitioner alleges that Respondent has failed to comply with Judge McKellar's Order.

This Division does not have jurisdiction to grant the relief sought by the Petitioner. Only the Circuit Court has the jurisdiction to enforce its own orders. Accordingly, this matter is hereby dismissed so that Petitioner may pursue his action in circuit court.
