ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division ("Division") pursuant to Appellant's Notice of Appeal filed
April 27, 2000. Appellant requested the Division reinstate ninety days good time and reinstate Appellant's Level 1 custody
status. Respondent filed a Motion to Dismiss on August 28, 2000, asserting in part that Appellant's claim was moot because
he was released from prison. On December 20, 2000, Respondent also filed an exhibit showing Appellant, in fact, was
released on parole on August 4, 2000.
An issue is moot when a judgment on the issue will have no practical effect on an existing case or controversy. Mathis v.
South Carolina State Highway Dep't, 260 S.C. 344, 195 S.E.2d 713 (1973). Because Appellant was released from prison,
the issues involved in this appeal are rendered moot.
IT IS HEREBY ORDERED that Respondent's Motion to Dismiss is granted and this appeal is dismissed with prejudice.
AND IT IS SO ORDERED.
