The Department of Corrections filed a Motion to Dismiss this matter on the grounds that the Appellant has been released from custody with such release rendering this appeal moot. The motion is granted.



A controversy becomes moot when a judgement on the issue will have no practical effect on an

existing case. Mathis v. South Carolina State Highway Dep't, 260 S.C. 344, 195 S.E.2d 713 (1973). Here, Appellant complains of the conduct of prison guards. Since Appellant has been released he is not longer subject to the conduct of any guards. Thus, this matter is dismissed as moot.
