ORDERS:
ORDER OF DISMISSAL
The
Respondent moved for an Order of Dismissal by Motion dated August 1, 2006,
based on the fact that the federal Social Security Administration had denied
the Appellant’s disability request, and under federal law, that ruling is
binding on the Respondent for a period of twelve months. The Appellant did not
respond to the motion.
Since
the Respondent did not have subject matter jurisdiction to determine the
Appellant’s disability, the Administrative Law Court does not have jurisdiction
on the same issue.
IT
IS THEREFORE ORDERED that this case is DISMISSED.
AND
IT IS SO ORDERED.
