ORDERS:
ORDER GRANTING MOTION TO REOPEN
By an Order of Dismissal issued on May 15, 2003, this tribunal found Petitioner in default and
dismissed the above-captioned matter for Petitioner’s failure to appear at the scheduled hearing of
this case. By a Motion to Reopen filed that same day, Petitioner provided an explanation for his
failure to appear at the hearing and moved this tribunal to reopen this matter based upon his excusable
neglect.
Therefore, as Petitioner has presented sufficient grounds for reopening this matter, and as
the Department of Revenue has no objection to the reopening of this case,
IT IS HEREBY ORDERED that the above-captioned case will be reinstated to the active
docket of the Administrative Law Judge Division if, within fifteen (15) days of the date of this Order,
Petitioner remits the sum of $80.00 to the Administrative Law Judge Division, P.O. Box 11667,
Columbia, South Carolina 29211 for the court costs of the hearing at which he failed to appear.
AND IT IS SO ORDERED.
