ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the South Carolina Administrative Law Judge Division. On December 6, 2000, I
issued an Order for Prehearing Statements requiring all [arties to submit Prehearing Statements within fifteen (15) days of
the date of the Order. On December 20, 2000, the Respondent filed its Prehearing Statement. Also on December 20, 2000,
the Petitioner requested additional time within which to file his Prehearing Statement. This was granted by my Order of
Extension dated January 2, 2001 giving the Petitioner an additional thirty (30) days within which to file his Prehearing
Statement. As of close of business February 12, 2001, this Court had received no Prehearing Statement from the Petitioner.
Pursuant to Rule 23 of the Rules of Procedure for the Administrative Law Judge Division, a Judge may dismiss a contested
case adverse to a defaulting party. A default occurs when a party fails to comply with any interlocutory order of the Judge.
It is therefore
ORDERED that this contested case is DISMISSED.
AND IT IS SO ORDERED.
