ORDERS:
ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Court
pursuant to Petitioner’s request for a contested case hearing. The South
Carolina Department of Revenue (Department) denied Petitioner’s request for an
on-premises beer and wine permit and nonprofit private club liquor license due
to a public protest as to suitability of the location by R.H. Patterson. Based
on the Agency Information Sheet sent by the Department, but for this protest,
the permit would have been granted. By letter received on April 1, 2006, the
Protestant withdrew his protest due to his inability to attend the hearing.
Because the Department would have granted the permit and license but for the
protest, and the protest has been withdrawn,
IT IS HEREBY ORDERED that this matter is dismissed with prejudice;
and
IT IS FURTHER ORDERED that the Department issue an on-premises
beer and wine permit and nonprofit private club liquor license to the
Petitioner for its location at 1705 White Horse Road, Greenville, SC.
AND IT IS SO ORDERED.
