A hearing on the merits in this matter was scheduled to begin at 2:00 p.m. on Thursday, May 11, 2006. Prior to the hearing, the parties agreed upon and signed a “Voluntary Agreement as to Restrictions”. Kenneth E. Allen, Esquire, attorney for Respondent, then read the “Voluntary Agreement as to Restrictions” into the record. A revised typed copy of the agreement, reflecting the handwritten changes, will be circulated by the parties and submitted to the Court for filing.

Based on the signing and reading into the record of the “Voluntary Agreement as to Restrictions” the parties hereby consent to the dismissal of the above referenced case.

IT IS THEREFORE ORDERED that the above referenced contested case is HEREBY DISMISSED.
