ORDERS:
CONSENT ORDER
The Respondent establishment was previously owned by Michael
Hass. Mr. Hass
has sold all interests in this establishment to a third
party who has no previous
management interest therein. Mr. Hass has voluntarily
surrendered the on premises
licenses which the establishment held under his ownership,
consequently, Mr. Hass
no longer operates any establishments licensed to sell beer,
wine or alcoholic liquors
in South Carolina.
The Department and Mr. Hass wish to resolve the matter of
the pending violations which
alleged a third violation of a sale of beer an under aged
confidential informant pursuant to
South Carolina Code Ann. Section of Regs. 7-200.4. Mr.
Hass does not contest this
allegation.
As such, the parties agree that Mr. Hass will not reapply
for any State licenses for a
period of one year from the date of the surrender of the
licenses at issue, to wit
the licenses were received on March 6, 2006. If Mr. Hass
does reapply in any capacity
the Department will deny the applications citing this Order
as the reason. Mr. Hass
cannot be an undisclosed owner of any corporation,
partnership, LLC or unincorporated
organization, or sole proprietorship which would apply for
any licenses within the
stated one year period outlined in this Order.
The Department agrees that the new owner of the
establishment will not be affected by
this Order. The new owner is Arthur Smith, and his licenses
shall not be affected by this
Order as he continues to operate Johnson’s Pub LLC, d/b/a
Downstairs at Johnsons,
located at 12 Cumberland Street, Charleston, South Carolina. The purchase of the
business by Arthur Smith totally divested Michael Hass of
any interest in this business,
and by this Order, he cannot reacquire an interest.
IT IS ORDERED, ADJUDGED AND DECREED, that Michael Hass is
prevented from
directly or indirectly owning or applying for any form of
State Alcoholic Beverage
License for one year from the date of March 6, 2006.
