ORDERS:

ORDER

This matter comes before the Administrative Law Court (ALC) upon the Petitioner’s request for a contested case hearing to review a decision of the Respondent, South Carolina Department of Transportation (Department), denying the Petitioner’s application for certification as a Disadvantaged Business Enterprise (DBE). At the Petitioner’s request, a contested case hearing on the merits was held at the offices of the ALC, on March 28, 2006. Following Petitioners presentation of its case in chief, the Department informed that ALC that it no longer contested granting DBE certification to the Petitioner. Based upon the Department’s stipulation,


IT IS THEREFORE ORDERED that DBE certification be granted to Pozzolanic Contracting & Supply Co., Inc. within five (5) days of the date of this Order.

AND IT IS SO ORDERED.
