ORDER OF DISMISSAL

On December 5, 2005, Pastor Donald Mitchell Houston of the Carteret Street United Methodist Church, the sole protestant of record in the above-captioned matter, notified the Court that he wished to withdraw his protest of Petitioner’s application for an on-premises beer and wine permit. Therefore, as the sole protestant in this matter has withdrawn his protest of Petitioner’s permit application, see S.C. Code Ann. § 61-4-525 (Supp. 2004); 23 S.C. Code Ann. Regs. 7-201(6) (Supp. 2004),

IT IS HEREBY ORDERED that the hearing of the above-captioned matter scheduled for Tuesday, December 6, 2005, is CANCELED and this case is DISMISSED.

IT IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina Department of Revenue shall CONTINUE TO PROCESS Petitioner’s application for an on-premises beer and wine permit for the premises located at 706 Craven Street in Beaufort, South Carolina.

AND IT IS SO ORDERED.
