ORDERS:
ORDER OF DISMISSAL
On November 15, 2005, Sandra Lemons, the sole protestant of record in the above-captioned matter, notified the Court that she would not be able to attend the hearing of this case scheduled for Wednesday, November 16, 2005. Therefore, as the sole protestant in this matter has withdrawn her protest of Petitioner’s application for an off-premises beer and wine permit, see S.C. Code Ann. § 61-4-525 (Supp. 2004); 23 S.C. Code Ann. Regs. 7-201(6) (Supp. 2004),
IT IS HEREBY ORDERED that the hearing of the above-captioned matter scheduled for Wednesday, November 16, 2005, is CANCELED and this case is DISMISSED.
IT IS FURTHER ORDERED that, pursuant to this dismissal, the South Carolina Department of Revenue shall CONTINUE TO PROCESS Petitioner’s application for an off-premises beer and wine permit for the premises located at 752 U.S. Highway 21 South in Ridgeway, South Carolina.
AND IT IS SO ORDERED.
