These matters are currently pending before the South Carolina Administrative Law Judge

Division. These matters involve the denial of the Petitioner’s request for an off premises beer and wine permit and retail liquor license by the Department of Revenue based on a public protest as to suitability of the location by Chris Kokolis of Columbia, South Carolina. Based on the Agency Transmittals sent by the Department, but for the public protests, the off premises beer and wine permit and retail liquor license would have been granted. By letter received from James V. McDuffie, Applicant, on April 1, 2003, the Applicant withdrew his application based on the loss of his lease for the proposed locations. There being no further cases in controversy,

It is hereby ORDERED that these matters are dismissed with prejudice.

AND IT IS SO ORDERED.
