ORDERS:
CONSENT ORDER
This contested case is before the Administrative Law Court for a retail liquor license application filed by the Petitioner, Sunom, LLC d/b/a Smart Shop. The Respondent, South Carolina Department of Revenue denied the application based solely on the protest received from Betty Jo Kazmierczak. The Petitioner has learned that Ms. Kazmierczak does not reside in Lexington County where the proposed location is located, nor within five miles of the location as required by SC Code Ann. §61-6-1825. The Petitioner therefore moves that the case be dismissed and the application be approved upon completion of the final inspection and the payment of all fees and costs.
AND IT IS SO ORDERED.
