ORDERS:

ORDER OF REMAND

This matter comes before the Administrative Law Court (ALC or Court) pursuant to Appellant's request for relief in which he set forth that Respondent Department of Corrections (Department) had ignored his request for a prayer room after a September 2004 grievance was returned to him as "unprocessed." In its Motion for Remand filed on January 31, 2005, Respondent set forth that "because two of Muhammad's grievances (both regarding religion, incidentally) are currently being processed, the Department respectfully requests that this case be remanded to the Department so that is can complete its review and render a final agency decision." Therefore, based on the foregoing,

IT IS HEREBY ORDERED that this appeal be REMANDED to the Department so that it can complete its review and render a final agency decision.

AND IT IS SO ORDERED.
