ORDERS:
ORDER OF REMAND
This
matter comes before the Administrative Law Court (ALC or Court) pursuant to the
appeal of Marcus Kelly, in inmate incarcerated with the Department of
Corrections (Department). Appellant alleges that the Department wrongfully
upheld a charge of "Sexual Assault." In its Motion to Remand filed
on June 3, 2005, the Department requests that this matter be remanded to the
Department so that it may re-issue its final agency decision.
IT
IS THEREFORE ORDERED that this appeal be REMANDED to the Department
for it to re-issue a final agency decision within thirty (30) days from the
date of this Order.
AND
IT IS SO ORDERED.
