The above-captioned case is before this Court upon the protests filed by several North
Charleston residents against the issuance of an on-premises beer and wine permit and a
restaurant minibottle license to Petitioner Brenda Stewart for a nightclub and lounge to be
located at 5075 Dorchester Road in North Charleston, South Carolina. Respondent South
Carolina Department of Revenue (Department) has concluded that Petitioner meets all of the
statutory requirements for the issuance of the requested permit and license, and would have
granted the permit and license but for the protests filed by local residents regarding the
suitability of the proposed location. On March 9, 2005, Petitioner and the protestants in this
matter reached a settlement of this case by agreeing upon certain stipulated restrictions to be
incorporated into Petitioner’s permit and license. Therefore, as the protestants of record in this
matter have withdrawn their protest of Petitioner’s application pursuant to this settlement,
IT IS HEREBY ORDERED that the above-captioned case is DISMISSED.
IT IS FURTHER ORDERED that, pursuant to this dismissal, the Department shall
CONTINUE TO PROCESS Petitioner’s application for an on-premises beer and wine permit
and a restaurant minibottle license for the premises located at 5075 Dorchester Road in North
Charleston, South Carolina.
AND IT IS SO ORDERED.
