ORDERS:
ORDER OF REMAND
This matter comes before the Administrative Law Court (ALC or Court) pursuant to the
appeal of Curtis Richardson, an inmate incarcerated with the Department of Corrections
(Department). In his request for relief, Richardson alleges that the Department failed to respond
to his grievance in which he challenges the calculation of his sentence by failing to account for
time he served in the State of North Carolina. In its Motion to Remand filed on January 13,
2005, the Department contends that is has no record that Richardson filed a grievance regarding
his sentence calculation and that "this case be remanded so that Richardson can re-file his
grievance within fifteen days of his receipt of an Order remanding the case." Based on the
foregoing,
IT IS THEREFORE ORDERED that this appeal be REMANDED to the Department
with Richardson granted fifteen (15) days from his receipt of this Order to re-file his grievance.
AND IT IS SO ORDERED.
