This matter is pending before the Administrative Law Court. The Court has been notified by the
applicant that an error was made in his application. Hemangini P. Patel has informed the Court
that in completing the license application for a beer and wine permit for the proposed location,
he inadvertently checked the box for an “on-premises beer and wine” permit, when, in fact, he
intended to check the space for an “off-premises beer and wine” permit.
The protestants have been contacted, and they have no objection to the Department granting a
license for an off-premises beer and wine permit. Further, by letter dated February 9, 2005,
protestants have withdrawn their protest. Accordingly, a controversy no longer exists.
Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed. The
Department shall continue to process the Petitioner’s application for an off-premises beer and
wine license for the establishment known as Harsidhma/Varahima Four, Inc., d/b/a Quick Food
Mart #4, 435 N. Main Street, Whitmire, South Carolina.
AND IT IS SO ORDERED.
