In the above-captioned matter, Appellant challenges a final determination by Respondent
South Carolina Department of Corrections (Department) regarding the application of credit for time
served in jail to his sentence. However, upon reviewing this appeal, the Department determined
that its earlier response concerning Appellant’s credit for jail time was inaccurate, and, by a motion
dated January 4, 2005, it requested that this case be remanded to the Department for it to provide
Appellant with an accurate response to his concerns about his jail-time credit, with the
understanding that Appellant can appeal the Department’s decision upon remand if he remains
unsatisfied with the decision.
IT IS THEREFORE ORDERED that this matter is hereby REMANDED to the
Department so that it can provide Appellant with an accurate determination regarding his credit for
time served in jail.
IT IS FURTHER ORDERED that the Department must provide Appellant with this new
response within thirty (30) days of the date of this order.
