In the above-captioned matter, Appellant challenges a final determination by Respondent
South Carolina Department of Corrections (Department) regarding the level at which he may earn
work credits. However, upon reviewing its policy for this appeal, the Department determined that
its earlier response concerning Appellant’s earned work credit level was inaccurate, and, by a
motion dated January 4, 2005, it requested that “this case be remanded to the Department so that it
may issue an amended Step 2 [Inmate Grievance Form] regarding [Appellant’s] earned work credit
eligibility.” Appellant has not responded to this motion.
IT IS THEREFORE ORDERED that this matter is hereby REMANDED to the
Department so that it can provide Appellant with an accurate determination of his eligibility for
earned work credits.
IT IS FURTHER ORDERED that the Department must provide Appellant with this new
response within twenty (20) days of the date of this order.
