ORDERS:
CONSENT ORDER OF DISMISSAL
This
matter arose on the Petitioners’ request for contested case review of a
decision by the Respondent South Carolina Department of Health and
Environmental Control (“DHEC”) to approve the Respondent Trident Medical Center
application for a Certificate of Need (“CON”) for construction and renovation
for the purchase and installation of a fixed Positron Emission
Tomography/Computed Tomography (“PET/CT”) scanner and an Elekta Synergy S
linear accelerator for a total of three linear accelerator vaults to be located
at the Trident Cancer Center.
It
now appears that the dispute among the Petitioner and Respondents has been
resolved. The parties to this litigation hereby request that the above
captioned case be dismissed with prejudice through this Consent Order of
Dismissal. The Court further orders DHEC to issue a CON to Trident Medical Center as described in DHEC’s decision letter of October 24, 2008 approving
the CON Application.

IT IS SO ORDERED.
