CONSENT ORDER OF DISMISSAL

This matter arose on the Petitioners’ request for contested case review of a decision by the Respondent South Carolina Department of Health and Environmental Control (“DHEC”) to approve the Respondent University Medical Associates of The Medical University of South Carolina (“UMA”) and Respondent Medical University Hospital Authority (“MUHA”)[1] application for a Certificate of Need (“CON”) to purchase and install a 16-slice Computed Tomography (“CT”) scanner and to provide outpatient chemotherapy infusion services.

It now appears that the dispute among the Petitioner and Respondents has been resolved. The parties to this litigation hereby request that the above captioned case be dismissed with prejudice through this Consent Order of Dismissal. The Court further orders DHEC to issue a CON to UMA and MUHA as described in DHEC’s decision letter of October 24, 2008 approving the CON Application.


AND IT IS SO ORDERED.
