ORDERS:
ORDER OF DISMISSAL
This
matter comes before the Administrative Law Court (ALC or Court) pursuant to a
request for contested case hearing filed by David C. Thomas. Mr. Thomas
appealed the October 23, 2007 Order revoking his Resident Producer’s License
for violating S.C. Code Ann. § 38-43-130 (Supp. 2007). On November 14, 2008,
the Department filed a Motion to Dismiss which set forth that during the
pendency of this case, a new complaint was filed against Mr. Thomas. As a result
of that case his license was revoked. Mr. Thomas was given thirty (30) days in
which to appeal the Department’s subsequent revocation. However, he never
requested a hearing on the new revocation matter. As a result, the revocation
of Mr. Thomas’s license became final and thus this case is now moot. See Mathis v. S.C. State Highway Dep’t, 260 S.C. 344, 195 S.E.2d 713 (1973)
(An issue is moot when a judgment on the issue will have no practical effect on
an existing case or controversy.) Therefore, finding good cause,
IT IS HEREBY
ORDERED that this case be DISMISSED.
AND IT IS SO
