ORDERS:
CONSENT ORDER FOR VOLUNTARY DISMISSAL
The Petitioner,
Lowcountry Medical Associates (“LMA”), hereby seeks to voluntarily dismiss this
contested case, which was originally requested on November 19, 2007, for an
administrative review of the final agency decision by the Respondent, South
Carolina Department of Health and Environmental Control (“SCDHEC”) to deny
LMA’s request for an exemption for certificate of need review of the
purchase/installation of a CT Unit for use within an imaging center. SCDHEC
consents to this voluntary dismissal. There being no further controversy,
IT IS HEREBY
ORDERED that the above-captioned case be and hereby is dismissed. This
dismissal shall be without prejudice as to the Petitioner’s ability or rights to
pursue other and further requests for an exemption for certificate of need review
for a CT Unit.
AND IT IS SO
ORDERED.
