ORDERS:
ORDER OF DISMISSAL
In
the above-captioned matter, Petitioner South Carolina Department of Insurance
(Department) sought the revocation of Respondent’s producer’s license based
upon his failure to remit premiums collected from clients. However, after
filing the matter with this court, the Department recently learned from Conseco
Services, L.L.C., the original complainant, that the $150,000.00 debt owed by
Mr. Banks did not relate to failure to remit premiums but related to a
promissory note for a loan to him. By letter filed on February 20, 2008, the
Department moved for the dismissal of this case with prejudice because it is a
private civil matter and not within the Department’s jurisdiction. IT IS
THEREFORE ORDERED that the above-captioned matter is hereby DISMISSED
with prejudice.

IT IS SO ORDERED.
