ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, Petitioner South Carolina Department of Insurance
(Department) seeks the revocation of Respondent’s bail bondsmen’s license for soliciting business
on jailhouse grounds, based upon an incident that occurred in late 2002. However, after filing the
matter with this Court in September 2004, the Department learned of certain criminal charges pending
against Respondent in Greenville County, and, by a motion filed on November 4, 2004, moved for
the dismissal of this case, without prejudice, pending the resolution of the criminal proceedings
against Respondent. While this tribunal is concerned with the Department’s dilatory prosecution of
its revocation of Respondent’s license, it does seem clear that the outcome of Respondent’s pending
criminal proceedings will have a significant impact upon the Department’s actions with regard to
Respondent’s license and that the interests of judicial economy weigh in favor of having a single
administrative proceeding against Respondent’s license, including a single hearing before this tribunal,
based upon the totality of Respondent’s conduct, rather than multiple such proceedings and hearings.
IT IS THEREFORE ORDERED that the above-captioned matter is hereby DISMISSED
without prejudice.
AND IT IS SO ORDERED.
