ORDERS:
ORDER OF CONSOLIDATION
These
matters are currently pending before the South Carolina Administrative Law
Court. On December 27, 2007, Hilton Head Regional Medical Center filed a
motion to consolidate the above matters because they involve common questions
of law and the same underlying facts. MRI at Belfair, LLC and the Respondents
consent to consolidation of these matters. The court finds that the same or
substantially similar evidence is relevant and material to the matters at issue
in each case. Therefore, in the interest of judicial economy and with the
consent of all parties, it is hereby
ORDERED that these matters are consolidated into one contested case pursuant to ALC
Rule 19(D). It is further
ORDERED that the caption in this matter shall read “MRI at Belfair, LLC and Hilton
Head Regional Medical Center, Petitioners, vs. South Carolina Department of
Health and Environmental Control and Southern MRI, Respondents,” and shall bear
Docket No. 07-ALJ-07-0538-CC. The file for Docket No. 07-ALJ-07-0600-CC shall
be closed and merged into Docket No. 07-ALJ-07-0538-CC.
