ORDERS:
ORDER OF REMAND
This matter is before the Administrative Law Court (“Court”) pursuant to the appeal of Keeon Butler, an inmate incarcerated with the Department of Corrections (“Department”). On September 5, 2006, Butler filed a grievance challenging his conviction of Sexual Misconduct. Butler filed his appeal with the Court on March 15, 2007.
On May 14, 2007, the Department filed a Motion to Re-hear, stating that during its review and investigation of Butler’s claim it discovered that the tape recording of the disciplinary hearing was missing. As a result, the Department believes that Butler’s case should be remanded to the disciplinary officer for a re-hearing on this matter. Accordingly,
IT IS HEREBY ORDERED that this matter is remanded to the Department with instructions that the Disciplinary Officer re-hear this matter.
AND IT IS SO ORDERED.
