ORDERS:
CONSENT ORDER
The
Petitioner, Samuel Crain, initiated this matter after Respondent, South
Carolina Law Enforcement Division (SLED) revoked Petitioner’s Private Detective
Company License. Petitioner’s license was revoked after he was charged with
Criminal Domestic Violence of a High and Aggravated Nature (S.C. Code §
16-25-65), Stalking (S.C. Code § 16-3-1720(a)) and Common Law Obstruction of
Justice. SLED may revoke a registration if a registered individual has been
charged with a crime which would, upon conviction, disqualify a person for
registration, pursuant to S.C. Code § 40-18-130(A)(12). Petitioner appealed
SLED’s decision to revoke his license in a timely manner pursuant to S.C. Code
§ 40-18-130.
In
a consent order dated May 23, 2006 it was agreed that the above-captioned
matter should be held in abeyance until the pending charges against Petitioner
were resolved. Subsequently, the charges of Stalking and Criminal Domestic
Violence of a High and Aggravated Nature were dismissed and Petitioner was
successful in having these charges expunged from his record. Petitioner was
offered PTI for the remaining charge of Common Law Obstruction of Justice and
he was able to successfully complete the program.
Accordingly,
SLED no longer seeks to revoke Petitioner’s Private Detective Company License.
As Petitioner no longer requires a hearing on this matter, I order the matter Resolved.

IT IS SO ORDERED.
